Welcome to Elevate Motion. By accessing or using our website and services, you agree to the following terms and conditions:

1. Services

Elevate Motion provides video production, photography, design, digital content, website visuals, event coverage, internal communications content, testimonials, campaign assets, and related creative services.

Details of each service, project scope, deliverables, timelines, usage requirements, and fees will be agreed in writing before work begins. This may be confirmed by proposal, quote, invoice, email, contract, or other written agreement.

2. Payment

Payment terms, timelines, deposits, project fees, and balance payments will be specified in your individual proposal, quote, invoice, or written agreement.

Unless otherwise agreed, a deposit or advance payment may be required before work begins, with the remaining balance due according to the agreed payment terms.

Late payments may delay project delivery, release of final files, future revisions, or additional work.

3. Intellectual Property

All original creative work produced by Elevate Motion remains the intellectual property of Elevate Motion until full payment is received.

Upon full payment, the client receives the agreed rights to use the final approved deliverables for the agreed purposes.

Final deliverables may include edited videos, exported files, selected photographs, graphics, design assets, website visuals, or other agreed project outputs.

Drafts, raw footage, unedited photographs, project files, unused concepts, editing timelines, source files, and working files remain the property of Elevate Motion unless otherwise agreed in writing.

4. Client Responsibilities

Clients are responsible for providing accurate information, briefs, brand assets, scripts, approvals, schedules, access, locations, participant availability, and any materials required to complete the project.

Clients are also responsible for securing any necessary permissions, access approvals, filming permissions, location permissions, participant consent, brand approvals, and internal sign-offs required for their organisation.

Delays in providing information, feedback, approvals, access, or required materials may extend the project timeline.

5. Revisions and Scope Changes

The number of included revision rounds, where applicable, will be outlined in the project proposal or written agreement.

Revisions must relate to the agreed project scope and deliverables. Major creative changes, new deliverables, additional filming, extra editing, new formats, extended versions, or changes outside the agreed scope may require additional fees and a revised timeline.

6. Project Delivery

Final files will be delivered in the agreed formats and through appropriate delivery methods such as download links, cloud storage, review platforms, video hosting, or other agreed channels.

Elevate Motion will take reasonable care to store and deliver project files securely, but clients are responsible for downloading, saving, and backing up final deliverables once supplied.

7. Confidentiality

Where projects involve confidential business, corporate, healthcare, pharmaceutical, internal communications, employee, or sensitive client information, Elevate Motion will treat supplied materials and project content with care and discretion.

Confidential project content will not be shared publicly without client approval, unless already publicly available or otherwise agreed in writing.

8. Portfolio Use

Unless otherwise agreed, Elevate Motion may reference completed work, client names, project types, stills, behind-the-scenes content, or final deliverables for portfolio, website, social media, marketing, or promotional purposes.

For confidential, internal, healthcare, pharmaceutical, or restricted projects, portfolio use will only take place where permission has been granted or where content is suitable for public sharing.

9. Liability

Elevate Motion is not liable for any indirect, incidental, or consequential damages resulting from the use of our services, website, or final deliverables.

We make no guarantees of specific business results, sales, engagement, rankings, views, conversions, or commercial outcomes from our work.

Clients are responsible for reviewing and approving final content before publication or distribution.

10. Cancellation and Termination

Either party may terminate a project by written notice.

Work completed up to the point of cancellation or termination will be billed accordingly. Deposits, booking fees, and payments for work already completed are non-refundable unless otherwise agreed in writing.

If a project is postponed, cancelled, or rescheduled by the client, additional costs may apply depending on preparation work completed, crew bookings, equipment bookings, travel, scheduling, or other project commitments already made.

11. Third-Party Services

Some projects may involve third-party services such as music licensing, stock footage, voiceover, subcontractors, hosting platforms, video review tools, cloud storage, web platforms, plugins, fonts, or other production-related services.

Any third-party costs, licences, restrictions, renewal fees, or usage terms will be outlined where applicable and may be subject to the third party’s own terms and conditions.

12. Governing Law

These terms are governed by the laws of Ireland. Any disputes will be resolved under Irish jurisdiction.
